There is no implication. If I want to broadcast a crappy old B&W Donna Reed TV show on ATSC 3 - I could. Poor video quality and abysmal sound. Still it’s Nextgen.

Yes, KNAV is still actively broadcasting unencrypted ATSC3, it’s KERA’s 4 programs in HEVC 720p60 w/ AC3 (not AC4) audio, with Kids/Create/World being very obvious 480i upscales.
